1. Acceptance of Terms
By accessing or using MakerAI™ ("the Service"), operated at getmakerai.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of the updated Terms.
2. Description of Service
MakerAI is an AI-powered platform that helps users research, validate, build, and market software products. The Service includes idea generation, market analysis, build planning with AI coding prompts, marketing plan creation, and visual asset generation. The Service is provided "as is" and "as available."
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any unauthorized use.
5. Subscriptions & Payments
The Service offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
All fees are non-refundable except as required by applicable law or as stated in our refund policy.
We reserve the right to change pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.
If payment fails, we may suspend or restrict access to your account until payment is resolved.
6. Ownership of Your Content
You retain ownership of all content you create using the Service, including business ideas, project data, marketing copy, and uploaded files. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide and improve the Service. We do not claim ownership of your projects or generated outputs.
7. AI-Generated Content
The Service uses AI to generate ideas, analysis, marketing copy, images, and other content. AI-generated outputs are provided for informational and creative purposes and should not be treated as professional legal, financial, or business advice.
You are solely responsible for reviewing, editing, and using any AI-generated content. We do not guarantee the accuracy, completeness, or suitability of AI outputs.
AI-generated images and copy may be subject to the terms of underlying AI model providers. You agree to use generated content in compliance with applicable laws.
8. Acceptable Use
You agree not to:
Use the Service for any illegal, harmful, or fraudulent purpose.
Upload content that is defamatory, obscene, infringing, or otherwise objectionable.
Attempt to reverse-engineer, decompile, or extract source code from the Service.
Interfere with or disrupt the Service or its infrastructure.
Resell, redistribute, or sublicense the Service without our written consent.
Create multiple accounts to abuse free tier limits.
Use automated systems (bots, scrapers) to access the Service without permission.
9. Intellectual Property
The Service, including its design, features, code, branding, and documentation, is owned by MakerAI and protected by intellectual property laws. "MakerAI" and the MakerAI logo are trademarks of MakerAI. You may not use our trademarks without prior written consent.
10. Third-Party Services
The Service integrates with or links to third-party services (e.g., payment processors, AI providers, community platforms like Skool). We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.
11. SMS & Text Messaging Terms
MakerAI may offer SMS/text messaging as part of the Service. By opting in to receive text messages, you agree to the following:
SMS Use Cases
Account verification and two-factor authentication codes.
Subscription and billing notifications (e.g., payment failures, renewal reminders, account suspension alerts).
Service updates, new feature announcements, and promotional offers.
Customer support communications when you initiate a support request.
Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. You may also opt out by emailing [email protected] with the subject line "SMS Opt-Out" and including the phone number you wish to unsubscribe. After opting out, you will receive a one-time confirmation message and no further texts unless you re-subscribe. Opting out of SMS does not affect your account or access to the Service.
Message & Data Rates
Standard message and data rates may apply to any SMS messages sent or received, depending on your mobile carrier and plan. MakerAI is not responsible for any messaging or data charges imposed by your carrier. Message frequency varies based on your account activity and preferences.
Carrier Liability Disclaimer
MakerAI and mobile carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission by your mobile carrier and network conditions. Carriers are not responsible for the content of any messages sent through the Service.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC BUSINESS RESULTS FROM USING THE SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKERAI AND ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless MakerAI, its founders, employees, and affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may cancel your account at any time through account settings. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
